Section 60I Certificates

Understanding your next steps in a parenting dispute

If you are having difficulty reaching agreement about parenting arrangements, Family & Property Mediation Australia can help you understand the Family Dispute Resolution (FDR) process and assess whether mediation is appropriate.

Accredited Practitioners

Our practitioners are accredited by the Australian Government Attorney-General’s Department and can issue Section 60I certificates where the legal requirements are met.

What is a Section 60I certificate?

Under section 60I of the Family Law Act 1975 (Cth), people generally need to attempt FDR and make a genuine effort to resolve parenting disagreements before applying to court for parenting orders, unless an exemption applies.

A Section 60I certificate records a particular outcome of the FDR process. It is not a parenting order and does not decide which parent is right or what arrangements should be made for a child.

How does our process work?

1. Book your individual intake

Meet privately with our practitioner by phone or Zoom for approximately 60–90 minutes. We discuss your circumstances, parenting concerns, safety and what you hope to achieve.

2. Assess suitability

Each participant is assessed separately. Mediation only proceeds when our practitioner considers it appropriate, taking account of safety concerns and each person’s ability to participate and negotiate freely.

3. Invite the other participant

Where appropriate, we contact the other person to explain the process and invite them to participate. You do not need to secure their agreement before contacting us.

4. Discuss the next steps

If mediation proceeds, we help you explore parenting arrangements with your children’s needs at the centre. If a certificate is appropriate, our practitioner explains the applicable category and what it means.

When can a certificate be issued?

The five categories cover situations where:

  • Another participant refuses or fails to attend.
  • The practitioner assesses FDR as inappropriate before mediation.
  • Everyone attends and makes a genuine effort.
  • Everyone attends, but one or more participants do not make a genuine effort.
  • Mediation begins but the practitioner assesses it as inappropriate to continue.

The practitioner determines the category based on the circumstances.

Can I book just to obtain a certificate?

Booking or paying for an intake does not guarantee a certificate. Our practitioner must follow the required process and exercise independent professional judgement.

You cannot choose a certificate category or purchase a particular outcome.

What if there are safety concerns?

Please raise concerns about family violence, intimidation, coercive control or safe communication during intake. Suitability is reviewed throughout the process, and mediation may not proceed or may be stopped.

Exemptions from the court’s FDR requirement can apply, including in some urgent matters or circumstances involving family violence or child abuse. Obtain independent legal advice about whether an exemption applies to you.

Take the next step

Book an individual intake to discuss your circumstances and understand the options available.
